1. Acceptance of these terms
By accessing this website, requesting a quotation, placing an order, signing a proposal or service agreement, making a payment, or using any service supplied by Empower Growth Partners LLP ("Empower Growth Partners", "we", "us" or "our"), you agree to these Terms & Conditions together with any applicable proposal, order form, statement of work, service-specific terms or written agreement.
If a separate written agreement signed by both parties conflicts with these general Terms & Conditions, the signed agreement will control to the extent of that conflict.
2. Our services
We provide business technology and growth services that may include business automation, CRM solutions, AI voice calling, recorded calling solutions, RCS or other business messaging, AI-powered customer experience solutions, AI graphics and video creation, AI consulting, training and upskilling, organic marketing, Meta advertising, Google advertising and related consulting or implementation services.
Specific scope, features, deliverables, timelines, usage limits, support arrangements and pricing may vary by package or project and should be confirmed in the relevant proposal or order documentation.
3. Eligibility & authority
Our services are primarily intended for businesses, organisations and adult professional users. If you place an order or accept these terms on behalf of a company or other entity, you represent that you have authority to bind that entity.
4. Proposals, quotations & orders
Quotations, proposals and commercial offers are based on the information available when they are issued and may be subject to validity periods, assumptions, exclusions and dependencies stated in the relevant document. An engagement begins only when we accept the order, receive any required advance payment, or otherwise confirm commencement in writing.
Any request that materially changes the agreed scope may require revised pricing, timelines or a separate change request.
5. Fees, invoices & payments
You agree to pay the fees, taxes and other charges specified in the applicable proposal, invoice or agreement. Payment schedules, advance amounts, recurring charges and credit periods, if any, will be stated in the relevant commercial document.
Unless otherwise agreed in writing, third-party media spend, platform charges, telecom usage, message charges, API costs, software subscriptions, hosting, premium assets, travel or other external expenses are separate from our professional fees.
6. Client responsibilities
You are responsible for providing accurate information, timely approvals, authorised account access, lawful data, suitable content and other materials reasonably required for us to perform the services. Delays in providing dependencies may affect timelines and delivery dates.
You are also responsible for reviewing deliverables, campaign settings, workflows, scripts, call flows, messages, prompts, audiences and other configured materials before launch where approval is requested or reasonably expected.
7. AI, voice calling & automation services
Artificial intelligence and automation systems may generate, classify, transform, route or respond to information. AI-generated outputs can contain errors, omissions or unexpected results and should not be treated as automatically accurate, complete or suitable for every purpose.
Where you provide contact lists, call scripts, prompts, recordings, customer data or other information for an AI or automation service, you are responsible for ensuring that you have the necessary rights, permissions, notices and consents to use that information and to conduct the relevant calls, messages or automated interactions.
You must not use our AI, calling, messaging or automation services for unlawful impersonation, deception, harassment, fraud, prohibited solicitation, infringement, abusive conduct or any activity that violates applicable law or third-party rights.
8. Advertising & marketing services
Marketing and advertising performance depends on many factors outside our control, including market conditions, competition, customer demand, offer quality, pricing, creative performance, website experience, platform algorithms and advertising policies. Unless expressly guaranteed in a signed agreement, we do not guarantee a specific number of leads, sales, conversions, rankings, impressions, revenue or return on advertising spend.
Advertising platforms may approve, reject, restrict, suspend or modify campaigns and accounts under their own policies. The client remains responsible for the legality and accuracy of claims, offers, products, landing pages and materials supplied for campaigns.
9. Third-party platforms & integrations
Our services may integrate with or depend on third-party products such as advertising platforms, CRM systems, telecom providers, messaging networks, cloud services, AI providers, payment services or other software. Your use of those third-party services may also be governed by their own terms, privacy policies, billing rules and acceptable-use requirements.
We are not responsible for outages, policy changes, account restrictions, pricing changes, data loss or service changes caused by third-party providers outside our reasonable control.
10. Intellectual property
Each party retains ownership of intellectual property it owned before the engagement or developed independently of it. Unless otherwise stated in writing, our methodologies, know-how, reusable workflows, frameworks, software components, templates, prompts, processes and pre-existing materials remain our property or that of our licensors.
Rights in custom deliverables specifically created for you will be governed by the applicable proposal or agreement and may be subject to full payment of all amounts due. Third-party assets, software, fonts, stock media, APIs, platforms and licensed materials remain subject to their respective licences.
11. Confidentiality
Each party should use reasonable care to protect non-public business, technical, commercial and customer information received from the other party and should use such information only for the relevant business relationship, except where disclosure is authorised, already lawfully known, independently developed, publicly available without breach, or required by law.
12. Privacy & data protection
Our handling of personal information through this website and our general business operations is also described in our Privacy Policy. Where we process data on your behalf as part of a service, additional data-processing terms may apply depending on the project.
You are responsible for ensuring that data supplied to us has been collected and shared lawfully and that required privacy notices, permissions and consents have been obtained.
13. Acceptable use
You may not use our website, systems or services to violate law, infringe intellectual property or privacy rights, distribute malware, gain unauthorised access, interfere with systems, send prohibited communications, conduct fraudulent activity, misrepresent identity, or engage in abusive, deceptive or harmful conduct.
We may refuse, restrict or suspend work that we reasonably believe could expose us, our partners or other persons to legal, security, reputational or operational risk.
14. Service disclaimers
We aim to provide our services with reasonable professional care. However, except where expressly stated in a signed agreement or required by applicable law, services and website content are provided on an "as available" basis without guarantees that they will be uninterrupted, error-free, compatible with every system or suitable for every business objective.
Information on our website is general business information and should not be treated as legal, financial, accounting or other regulated professional advice.
15. Limitation of liability
To the maximum extent permitted by applicable law, neither party will be liable to the other for indirect, incidental, special, punitive or consequential losses, or for loss of profit, revenue, opportunity, goodwill or anticipated savings arising from the services, except where such limitation is not permitted by law.
Any financial liability cap or service-specific remedy should be determined by the applicable proposal, order form or signed agreement. Nothing in these terms is intended to exclude liability that cannot lawfully be excluded.
16. Indemnity
You are responsible for claims, losses or liabilities arising from materials, data, instructions, campaigns, contact lists, offers, content or conduct supplied or authorised by you where they violate applicable law, third-party rights or these terms. Any specific indemnity obligations agreed for a project will be set out in the applicable written agreement.
17. Suspension & termination
Either party may end a service in accordance with the termination provisions stated in the applicable proposal or agreement. We may suspend or restrict services where invoices are materially overdue, continued performance would violate law or third-party policy, security is at risk, or there is a material breach of these terms.
Termination does not remove obligations that accrued before termination, including payment obligations, confidentiality requirements and provisions that by their nature should continue.
18. Force majeure
Neither party will be responsible for delay or failure caused by events beyond its reasonable control, such as major network or cloud outages, telecommunications failures, natural disasters, government action, war, civil disturbance, widespread cyber incidents, labour disruption or other comparable events, provided reasonable efforts are made to reduce the impact where practicable.
19. Governing law & disputes
Unless a separate written agreement states otherwise, these Terms & Conditions and the relationship between you and Empower Growth Partners LLP will be governed by the laws applicable in India. Subject to any mandatory dispute-resolution requirements or agreed arbitration provisions, courts having jurisdiction in Ahmedabad, Gujarat will have jurisdiction over disputes arising from these terms.
